High Court Judge, Justice Adrian Fisher, has ordered the suspended All People’s Congress (APC) executive to provide a detailed financial statement accounting for APC funds held in other bank accounts, in a landmark judgment delivered on Friday, August 28, 2026.
The order specifically directs Alhaji Osman Foday Yansaneh, who continues to present himself as APC Chairman, and Secretary General Lansana Dumbuya to account for APC monies held in other accounts.
The ruling followed an application brought by Alfred Peter Conteh and Mohamed Sheridan Kamara, challenging the legitimacy of the Yansaneh-led executive. Their lawyer, Jesse Jengo, argued in a notice of motion dated August 17, 2026, that the executive’s constitutional tenure had expired and that it therefore no longer had the mandate to remain in office.
Justice Fisher ruled that the Yansaneh-led executive had overstayed its tenure, which expired on February 13, 2026. The court held that the executive members were “no longer mandated to be serving in those capacities” because their three-year tenure had expired.
The judge further stated that the executive’s continued stay in office was contrary to Articles 52(a) and 52(b) of the 2022 APC Constitution, which provide for the management and transition of the party following the expiration of an executive’s tenure.
The defendants had previously relied on what was described as an extension granted by the Political Parties Regulation Commission (PPRC). However, Justice Fisher ruled that the PPRC had exceeded its statutory authority in purporting to transfer or extend the “authority of Management” of the APC beyond the constitutional mandate of the party’s executive.
According to the judgment, the PPRC lacked the legal basis to exercise such authority, noting that the power was not conferred upon the Commission under Section 39(5) of the 2022 Political Parties Act. The court therefore reaffirmed the supremacy of the APC Constitution in determining the tenure and authority of the party’s leadership.
The judgment represents a major development in the ongoing leadership dispute within the APC and places renewed emphasis on constitutionalism, accountability, internal democracy and respect for established party rules.
Against this backdrop, Alfred Peter Conteh has emerged in the eyes of his supporters as a strong advocate for constitutional order, democratic participation and inclusiveness within the APC.
