The Anti-Corruption Commission (ACC) has informed the general public that it has received original copy of the Tribunal Report, relating to the Auditor-General, Mrs. Lara Taylor-Pearce and Deputy Auditor-General, Mr. Tamba Momoh, and has also taken careful note of the Recommendations contained therein.
Accordingly, the Commission further state that, it will give deference to the Parliament of Sierra Leone to carry out its constitutional role and mandate, and thereafter, the Commission will decide on the next steps, relating to the specific issues referred to it in the Report of 29th May, 2024.
In that regard, the ACC reassures the public of its continued resolve to address matters of accountability and corruption across all levels of society in Sierra Leone.
Does this warrant a press release from the ACC? Or is this just giving a heads-up to the AG as, “I’ll be coming for you?”
A cursory read of the report shows it is prejudiced and appears to rely heavily on the state witnesses account rather than the law, acts and policies. Where convenient, it seeks to import inappropriate portions of the Constitution to support its preconceived bias. An example is the use of Subsection 2(d) of Section 171 of the Constitution to support the authority of the Tribunal to investigate the Deputy Auditor General. I believe this is wrong and a misapplication of the law. Unfortunately, I don’t believe there is room for appeal here. The rest of the report is a fishing expedition to “nail” the AG and Deputy AG.
