Justice Augustine K. Musa has sharply criticized the state prosecution for its repeated absences at the ongoing manslaughter trial of Ekubolaje Nicol, labeling their behavior as “unfair” and disrespectful to the court.
The latest absence reportedly occurred on Friday, December 5, 2025, when the prosecution failed to attend the trial, which concerned the death of Sinnah Kai Kargbo, Nicol’s girlfriend.
Speaking in court, Justice Musa expressed his dissatisfaction with the prosecution’s failure to provide proper notification or reasonable explanations for their previous absence during the last hearing. “This behavior is unfair to the court and disrespectful to the process,” the judge said.
The trial had been scheduled to continue on Friday, but due to the prosecution’s absence, the proceedings were delayed. Lead defense lawyer, Rowland Wright, informed the court that the defense had intended to make a bail application for Nicol but would now be forced to wait until the next hearing. Wright emphasized that manslaughter is a bailable offense and reiterated his request for bail for the defendant.
Despite the defense’s plea for a Christmas release, Justice Musa made it clear that the holiday season would not influence his decision on the bail application. “I will not take Christmas into consideration when making a decision regarding the bail application,” the judge stated firmly.
Ekubolaje Nicol is facing multiple charges, including conspiracy to commit murder, manslaughter, and perverting the course of justice, following the death of his girlfriend, Sinnah Kai Kargbo, on October 16, 2022. Kargbo’s death has sparked widespread attention, with many closely following the trial.
The court has adjourned the proceedings to Friday, December 19, 2025, when the trial will resume. In the meantime, the prosecution’s repeated absences have raised questions about their commitment to the case, leaving both the defense and the public waiting for further developments.
