In another turn of events, the state prosecutor in the murder case of Late Sia Fatu Kamara demands that the case be taken to the High Court of Sierra Leone describing it as a different  line of action. 

Addressing the magistrate court in the resumption of the trial on Wednesday, September 4, 2024, Yusif Isaac Sesay argued that the action was in the best interest of justice. He said that would ensure a speedy, fair, and expeditious trial for Abdul Kpaka who is accused of killing his girlfriend.

Lawyer Julian Cole in his submission mentioned to the court that the prosecution promised to make progress at this proceeding, pointing out that the liberty of the accused was at stake as he remains in custody.

Lawyer Cole expressed that he counted on the prosecution to have prepared well before coming to court because they had a week to do so. According to him, the court’s pride is based on expeditious proceedings, and the prosecution is legally obliged to make progress. The presiding magistrate said the defense cannot force the prosecution to proceed with their case while citing a provision in law, but he cautioned the prosecution to make progress at the next hearing.

36-year-old Kpaka is facing one count of murder that he allegedly committed on Tuesday, August 13, 2024. The case resumes on Monday September 9th, 2024.
