The case between the suspended Auditor General and Deputy, Lara Taylor Pearce, and Tamba Momoh, respectively and the State was presented at the High Court on Thursday 23rd November 2023, for another sitting.

During this sitting, the Principal State Counsel, A.D.M Bockarie told the court that they (The prosecution team of counsels) had closed their case.

While responding to this submission from the Prosecution, the Lead Defence Counsel Roland Wright asked the judges to give them some time so that they could be in full preparation for their full defense against the evidence and submissions put against their client by the Prosecution.
The appeal was granted to the Defence Counsel.

The issues under scrutiny include misconduct allegations against the Auditor General, encompassing breach of third-party information, confidentiality and conflict of interest, misuse of public funds, and lack of professional conduct.

The state has presented seven witnesses, including individuals from the specialized Unit of Audit Service, State-owned Enterprises, the Office of the Secretary to the President, a private consultant, Kamakwei Community Bank, and the Deputy Auditor General. The allegations being considered involve breaches of third-party information, confidentiality, conflict of interest, misuse of public funds, and a lack of professional conduct.

The Tribunal officially commenced on the 17th of March, 2022. Subsequent to directions given by the Judges of both Lara Taylor Pearce and Tamba Momoh properly commenced on the 9th of October 2023 despite several objections from the defense Counsel challenging the Jurisdiction of the Tribunal and requests for adjournment. The case has been adjourned to 30th November 2023.
