Magistrate Hadiru K Daboh of Ross Road Court No.3 in Freetown has discharged an accused commercial sex worker due to a lack of witnesses in the case.
19yrs-old Marion Fofanah, a commercial Sex worker was before the magistrate court on two count charges Wounding Contrary to Section 20 of the fences against the person Act 1861 and Assault Occasioning actual bodily harm contrary to section 47 of the offenses against the person Act 1861.
According to the particulars of the offense on 27th August 2022 at the Freetown Central lorry Park grass field Kissy Marion Fofanah maliciously wounded and assaulted Samuel Wray in a manner thereby occasioning him actual bodily harm.
The charges were read and explained to the accused person who pleaded guilty.
The accused person was unrepresented by legal counsel and she had been granted bail on her third appearance but failing to fulfil the bail conditions, she made fifteen appearances before the court
Meanwhile, after several adjournments without witnesses, Magistrate Daboh discharged the accused person with reference to section 94 of the Criminal procedure Act No.32 of 19655.
