A student from Fourah Bay College (FF) Raymund Kamara who was under preliminary investigation at the Magistrate Court will now face full trial at the High Court of Sierra Leone for allegedly wounding one Ishmail Conteh with intent to Murder.
The matter was committed yesterday by the Presiding Magistrate of the Pademba Road Court No. I, Magistrate Santigie Bangura on all three count charges, ranging from wounding with intent to murder contrary to Section 11 of the Offence Against the Person Act 1861, Wounding contrary 10 Section 20 of the Offences Against the Person Act 1861 and Assault Occasioning Actual Bodily Harm contrary to Section 47 of the Offences Against the Person Act 1861.
Committing the matter to the High Court, Magistrate Bangura said the accused is charged with three counts of wounding with Intent to murder, contrary to Section 11 of the Offences Against the Person Act of 1861, Wounding, contrary to Section 20 of the Offences Against the Person Act of 1861 and Assault Occasioning Actual bodily harm, contrary Section 47 of the Offences Against the Person Act of 1861.
It is alleged against him that on Sunday the 20th May, 2024, at No.2 River, Freetown, with intent to murder; assaulted and wounded Ishmael Conteh, and caused him injuries and grievous bodily harm.
Being that the charges were indictable in nature, in such a proceeding, it is for the Prosecution to adduce sufficient evidence that will establish a prima facia case to be answered by the accused on trial if he is to be committed to stand trial at the High Court.
Magistrate Bangura furthered that in establishing their case against the accused, the Prosecution called five witnesses including formal witnesses all of whom testified and were cross-examined.
“I have seen from the evidence that all the Prosecution witnesses were consistent on the fact that the accused did stab the victim therein with one of three objects he was holding: knife, a barbecue fork and a scissors. This came after hitting him with a stone. I have also seen the medical report in Exhibit A 1-5.” the presiding magistrate said.
Magistrate Bangura furthered that with this piece of evidence so far adduced before him the Prosecution have sufficiently connected the accused to the offences as alleged therefore committed him to the High Court for proper trial without bail.
