Thirty-two year old Joseph Fornah a Miner, twenty-nine year old Mamoud Kamara, a motorbike rider, twenty-four year old Farah Sesay, a business man and Maada Wahab Allieu a civil engineer made their first appearance before Magistrate Santigie Bangura of the Pademba Road Magistrate Court No. 2 in Freetown on three count charges to wit: conspiracy contrary to law, shop breaking and larceny contrary to Section 26 (1) of the Larceny Act 1916, and Receiving stolen goods contrary to Section 33 (1) of the Larceny Act 1916.

According to the charge sheet, on Thursday, 20th March, 2025 at No.4 Siakie Bockarie Street in Kabala Town, Koinadugu District, the accused conspired together and with other persons unknown to commit a felony to with shop breaking and larceny.

Count two further stated that on the same date and place the accused persons broke and entered into the shop of Alusine Barrie and stole therein 148 pieces of variety of android mobile phones, and physical cash of Fifty Thousand Leones (Le50, 000) all to the total value of Three Hundred and Thirty-five Thousand, Nine Hundred and Fifty Leones (Le335,950), being property of Alusine Barrie.

Count three furthered that on the same date and place a quantity of Ho750I mobile phones and assorted items were carted away all in total equivalence of One Hundred and Sixteen Thousand, One Hundred Leones (NLe116,100) being property of Alusine Barrie.

When the matter was mentioned in court the Fourth accused person was absent in the court.

The Prosecutor, Assistant Superintendent of Police Dialla Wellington applied for a Bench Warrant against the absentee accused person and the Sureties respectively.

The Defense Counsel, R.A.D. Jones applied for bail for and on behalf of the third accused person on grounds that he is a Sierra Leonean resident within the jurisdiction, and that he has reliable Sureties who are willing and ready to go into recognizance on behalf of the accused persons, and they should not interfere with the Prosecution Witness or witnesses nor should he/she jump bail.

Lawyer Jones made his application pursuant to Section 79 (2&3) of the Criminal Procedure Act of 1965.

Meanwhile, Magistrate Bangura refused bail for the 1st and 2nd accused persons, and ordered a bench warrant for the 4th accused person, and granted bail to the third accused person in the sum of One Hundred Thousand Leones (NLe 100, 000) with two Sureties in like sum, and the Sureties must be resident here in Freetown and must be responsible citizens, they should produce a valid NCRA identity card depicting his or her address in Freetown, and the bail must be approved by the Deputy assistant Registrar.

The Matter was adjourned to 30th April, 2025.
