The High Court of Sierra Leone presided over by Justice Adrian J. Fisher has last Friday 28th May, 2021 delivered a major ruling in the matter between Alfred Peter Conteh (Plaintiff) and the three defendants, Ernest Bai Koroma, Alhaji Osman Foday Yansaneh and the All People Congress party, (APC).

In delivering the ruling, Justice Fisher ordered that the cost of the application summarily assigned at thirty million Leones (Le30,000,000) shall be borne by the defendants and paid to the plaintiff forthwith (instant).

He said the first defendant, Ernest Bai Koroma, Chairman and Leader, second defendant, Alhaji Osman Foday Yansaneh, National Secretary General and third defendant, the All People’s Congress party, (APC) shall each pay Le 10M.

Justice Fisher further refused the three defendants applications for a stay of execution of the ruling of the 19th April 2021 and his orders, and also for leave to appeal the said ruling in the Court of Appeal.

The plaintiff by way of an ex-parte notice of motion dated 26th February, 2021 sought an interim junction restraining the 1st 2nd and 3rd defendants from holding any conference, convention or meeting geared towards selecting or electing delegates or candidates the legitimacy of the Ernest Bai Koroma led executives to hold party convention.

The initial ruling which led the appeal asked for the defendants’ counsels refused by the presiding judge prevented Ernest Bai Koroma, Alhaji Osman Foday Yansaneh, regional and district chairmen, constituency chairmen from participating in the pending emergency national delegate conference to be held not later June this year.
