Esteemed Justice of the Appeal Court sitting as High Court Judge in the High Court of Sierra Leone ( Land Property and Environment Division), Hon . Mr. Justice Kombat Kamanda has dealt a devastating blow to Moshen Taraff ( Plaintiff) in his attempt to take possession of piece and parcel of land situated at No.27 Wilkinson Road in Freetown.

In his ruling dated 29th June, 2022 ,.Mr. Justice Komba Kamanda  said, ” That the writ of Summons herein dated 8th April , 2022 is dismissed on the basis the 1st, 2nd and 3rd Defendants ( Sidi Mohamed Talib, Mariama Talib and the National Revenue Authority respectively) are not the proper parties to be brought to court in their capacity, as it is, and no course of action herein, could be maintained against them.

This ruling means tahi there is no more controversy over the piece and parcel of land bought by the NRA ( National Revenue Authority) from Mr . Mohamed Sabbagh , who has now been recognized by the High Court as the legitimate vendor.

It would be recalled that there have been many reports about NRA purchasing a Piece and percel of land at Wilkinson Roay in Freetown.The reports have alleged that the said land is contentious and that is subject to litigation.

After a thorough Investigation and Verification of the relevant documents, it is now very clear that the piece and parcel of land situate at No .27 Wilkinson Road in Freetown was legally purchased by NRA and that there’s no further legitimate claim to that Piece and parcel of land.

The matter that was in court, according to Investigation was in respect of specific performance of a contract for the sale of the said land by someone who, at the time of the country was not even the owner.

NRA therefore purchased the said land from the actual owner. NRA therefore purchased the said land from the actual owner with Valid title deeds This has laid to rest the varied speculations about the said piece of land
