The High Court of Sierra Leone, presided over by Honourable Mr. Justice Mohamed Bawoh, has ruled in favor of Jeneba Mado Kamara in the case of C.C. 9/24, 2024.

The case, held at the Makeni District Registry (General Civil Division No. 2), saw Kamara standing as the Plaintiff/Applicant against multiple defendants from the University of Makeni.

In April 2024, some final-year students at the University of Makeni (UNIMAK) were stopped from participating in the 2024 undergraduate convocation ceremony, and they filled a case against the University of Makeni for violating their right to Education.

The defendants included the University of Makeni as the 1st Defendant/1st Respondent, Rev. Fr. Prof. Joseph A. Turay (2nd Defendant/2nd Respondent), Mr. Foday Augustine Bangura (3rd Defendant/3rd Respondent), Rev. Fr. Dr. George P.B. Gbamanja (4th Defendant/4th Respondent), Dr. Santigie S. Kaba (5th Defendant/5th Respondent), and Mr. Mustapha Mahmoud Ishmail (6th Defendant/6th Respondent), all affiliated with the University of Makeni, Fatima Campus, Bombali District.

The court meticulously examined all evidence, submissions, and cited authorities. Justice Bawoh granted the plaintiff’s prayers, issuing several key orders:

Striking Out Defence and Counter-Claims: The defence and counter-claims filed by the defendants on April 17, 2024, were struck out. The court found these submissions lacked coherent statements of facts and failed to disclose any reasonable or material defence. The claims were deemed scandalous, frivolous, vexatious, and an abuse of the court process.

Judgment in Favor of Plaintiff: The court entered judgment in favor of Jeneba Mado Kamara for all applicable reliefs prayed for in her Writ of Summons dated March 25, 2024. Specifically, paragraph 5 of Kamara’s claims was to be assessed by the Master and Registrar.

Cost Awarded: The defendants were jointly and severally ordered to pay Kamara the sum of Le 100,000 (One Hundred Thousand New Leones) or One Billion Old Leones within seven days of the order.
