His Worship the Mayor Thomas Karimu Bandabla Baio has dragged Councilor Jusu Michael Kapu to court on criminal charges. Mayor Baio made his first appearance in person today at Court number two (2) presided over by Magistrate Brima Jah.

The matter which was first heard on Friday, July,12,2024 saw the mayor only represented by his solicitors but the accused Councilor Jusu Michael Kapu failed to appear again before the court of jurisdiction today when his name was announced. No notice of his absence was tendered in court.

Kapu is arraigned before the court to contest five (5) counts criminal charges brought against him by lead prosecution counsel Victor Ansumana Esq from the law firm Teddy Koroma & Associates.

The charge sheet contains the following offences.

COUNT 1

STATEMENT OF OFFENCE: Public Insult and Provocation contrary to section 2 of the Public Order Act No 46 of 1965.

PARTICULARS OF OFFENCE: That you Jusu Michael Kapu on the 8th day of July 2024 at Kenema City in the Eastern Province of the Republic of Sierra Leone used insulting words against the complainant in such a manner as would he likely to provoke him to commit a breach of the peace.

COUNT 2

STATEMENT OF OFFENCE: Insulting Conduct, contrary to section 3 (ii) of the Public Order Act No 46 of 1965.

PARTICULARS OF OFFENCE; That you Jusu Michael Kapu on the 8th day of July, 2024 at Kenema City council in the Eastern Province of the Republic of Sierra Leone used insulting language against the complainant to the annoyance of the complainant herein.

COUNT 3

STATEMENT OF OFFENCE: Abusive language Contrary to Section 3(I) of the Public Order Act No 46 of 1965.

PARTICULARS OF OFFENCE: That you Jusu Michael Kapu on the 8th day of July,2024 at Kenema City in the Eastern Province of the Republic of Sierra Leone did make use of Abusive language against the complainant with intent to provoke him to commit a breach of the peace.

COUNT 4

STATEMENT OF OFFENCE: Threatening Language Contrary to Section 3 (ii) of the Public Order Act No 46 of 1965.

PARTICULARS OF OFFENCE; That you Jusu Michael Kapu on the 8th day of July, 2024 at the Kenema City in the Eastern Province of the Republic of Sierra Leone did make use of threatening language to the annoyance of the complainant herein.

COUNT 5

STATEMENT OF OFFENCE: Intimidation contrary to section 4(i) of the Public Order Act No 46 of 1965.

PARTICULARS OF OFFENCE: That you Jusu Michael Kapu on the 8th day of July,2024 in the Eastern Province of the Republic of Sierra Leone unlawfully intimidated the complainant from going about his normal duties.

The Mayor rejected interviews from the press but instead referred to his solicitors.

The matter is adjourned to Tuesday, July 23 2024.
