On January 13, 2023, the Freetown High Court is scheduled to render its decision in the case involving Dr. Samura Mathew Wilson Kamara, a former minister of foreign affairs and international cooperation (MOFAIC), and five other co-accused parties in the ongoing trial initiated by the Anti-Corruption Commission (ACC) against them over allegations of misappropriation of the Chancery building in New York, USA.

The decision will determine whether the former minister’s defense team’s no-case submission will be upheld, allowing him to actively participate in the country’s upcoming general elections as he aspires to run for president of the main opposition All Peoples Congress (APC) in the general elections of 2023.

The presiding Judge, Hon. Justice Adrian Fisher, announced that he will issue a ruling on the specified date after the ACC lead prosecutor, Calvin Matesebo, concluded his case following the presentation of sixteen major and minor witnesses who testified in the aforementioned matter.

After carefully examining and carefully hearing all of the witnesses and pieces of evidence submitted before the court in the continuing process, the defense attorneys for the accused asked to make a no-case submission when the matter was brought up last Monday.

Additionally, they requested the court to swiftly resolve the issue so that their clients may successfully run in the upcoming general elections in 2023.

The ACC prosecution has pledged to appropriately address the defense’s no-case submissions when they are made.

The presiding Judge, Hon. Adrian Fisher, instructed the counsels for the accused to submit all of the no-case submissions to the court by or before December 31st of this year. As he will be referencing such literature and material when evaluating the submissions that will be presented from both parties, Justice Fisher further instructed the counsels from both sides to adhere to the Garberville no-case submission test.

Additionally, he stated that the court will proceed with any document it has and that any delays in filing and submitting all supporting documents with supporting facts and references will not be tolerated.
